A landlord, seller or outgoing operator may say that commercial premises “already have a licence”, yet provide only a payment receipt, an old technical project or a municipal file number. That is not enough to establish whether the intended business can open. The relevant record could be a licence, a start-of-activity communication or another form of administrative entitlement; the file could also still be under review.
Before signing a lease, purchase or business-transfer agreement, establish which activity appears in the records, who the registered operator is, which premises and layout the documents cover, and whether the procedure has been completed. If the enabling document is missing, Barcelona City Council lists a specific procedure for requesting a duplicate. Recovering it does not, however, update the operator or regularise later alterations.
What it means when premises “have a licence”
The legally precise expression is “enabling document”, translated from the Catalan and Spanish administrative term títol habilitant. Catalonia’s Law 18/2020 defines it as the document recognising entitlement to carry out an economic activity at an establishment. This is broader than “opening licence”: entitlement may arise from a licence, a communication or another applicable intervention system. The law also distinguishes the enabling document from its holder, the technical certificate and the technical project. [1]
For activities subject to the communication system under Law 18/2020, the operator digitally communicates the start of the activity and submits a technical certificate. A project signed by a competent technician is also required where the statutory annex calls for one because of the activity’s size or capacity. The communication enables the activity to operate under the responsibility of the holder and signing technician, while remaining subject to subsequent checks by the authorities. [3]
- Enabling document: records the administrative entitlement to conduct the activity.
- Licence: an administrative decision required for activities under a licensing regime.
- Communication: a notification and supporting documentation submitted under the relevant communication regime.
- Technical project or report: describes and justifies the proposed technical conditions.
- Technical certificate: certifies compliance with applicable requirements at the time it is issued.
Documents to request before renting, buying or taking over premises
Ask first for the enabling document, licence decision or complete proof of the activity communication, as applicable. You should also request the full municipal file number and the registered holder’s details. A fee receipt, works licence or isolated drawing does not independently establish the scope or status of the activity entitlement. Likewise, evidence that building work was authorised does not guarantee that the intended activity is admissible at the premises. [8]
The technical documents help you compare what was declared or approved with the premises as they stand today. Not every item will exist or be required in every case: the available records depend on the activity, its administrative regime and the history of the file. Where important documents are missing, consider obtaining access to or copies from the municipal file before entering into a binding commitment. District Technical Services provide appointments for certain technical queries, file follow-up and access or copy requests. [7]
- Enabling document, licence decision or proof of communication.
- Complete activity-file number and the holder’s identifying details.
- Technical project, report, certificate and filed plans.
- Initial inspection or control records, where applicable to that specific activity.
- Later modification notices and changes of holder filed with the authority after the original procedure and
How to check that the records match the current business
Start with the exact address, including the floor, unit, door or other identifier. Then compare the registered activity, holder, floor area and layout with the proposed business. Where the records specify capacity or permitted occupancy, check those details as well. Filed plans should correspond to the present public areas, storage rooms, kitchens, toilets, circulation routes and significant installations. A matching street address alone is not enough.
Look for work, extensions, revised layouts, new installations or changes of activity made after the filed project. Under Law 18/2020, non-substantial modifications must be brought to the authority’s attention, while substantial modifications require the data for the resulting activity to be communicated again. Do not assume that every physical change falls automatically into either category: the actual premises and complete file must be assessed to identify the appropriate procedure. [3]
- The address, unit details or plans do not match the premises.
- The documented activity differs from the business being advertised.
- Only a receipt or payment letter is available.
- The file is awaiting correction of deficiencies.
- Alterations or installations completed after the archived plans are not reflected in the documentation.
How to check the file status and request a duplicate
Barcelona City Council’s online status service covers activity files involving prior communications or environmental licences that are still being processed. It may show stages such as preliminary review, deficiencies pending, external reports, proposed decision or resolved. The official page states that this status check is free and can be made at any time. Importantly, “resolved” means that a decision has been issued and will be notified; it should not be interpreted automatically as approval. [5]
If the enabling document is unavailable, the City Council’s Electronic Office lists a separate procedure called “Duplicate of the enabling document for an activity file”. First identify the file, then consult the current procedure page to confirm who is entitled to apply, which identification or proof of representation is required, and which application channels are available. Retain the submission receipt and compare the duplicate with the actual premises when it arrives. Eligibility rules, channels, fees and processing arrangements may change, so verify them directly with Barcelona City Council rather than relying on an old checklist. [4]
- Gather the complete premises address and any known holder details.
- Find the activity-file number from decisions, communications, plans or receipts.
- Use the status service if the file is still being processed.
- Select the specific procedure for a duplicate enabling document, not a payment letter.
- Check current applicant, representation and identification requirements on the official page.
Payment letters, previous holders and altered premises
A duplicate enabling document is not the same as a duplicate payment letter. Barcelona City Council provides separate procedures: the payment letter concerns a tax or fee self-assessment, including relevant ICIO or municipal charges, whereas the enabling document records the administrative entitlement. The listed payment-letter duplicate procedure is free, but the resulting financial record does not establish which activity was enabled, what technical conditions applied or whether the file concluded favourably. [4] [6]
If the activity remains registered to somebody else, recovering their document does not transfer the administrative position to you. On transfer, the new holder must communicate the change, declare that the entitlement’s requirements and conditions continue to be met, and assume the related administrative rights and obligations. If the activity, layout or installations no longer correspond to the file, determine whether a modification or a different procedure is necessary before opening. This comparison is especially important after structural work, expanded floor area, revised capacity, new fire-safety arrangements or a change in the type of business. [3]
- Enabling document: records the documented administrative entitlement.
- Payment letter: concerns a fee or tax assessment rather than the technical scope of the activity.
- File-status check: shows the current processing stage, not necessarily a favourable outcome.
- Change of holder: updates the operator responsible for the activity and its obligations.
- Modification procedure: addresses relevant changes to the activity or its documented conditions.
Frequently asked questions
Can the owner of the premises request the duplicate?
It depends on who the current municipal procedure recognises as entitled to apply and on that person’s connection with the file. Ownership of the property does not necessarily make the owner the holder of the activity. Check the current City Council procedure and any representation requirements before applying on another person’s behalf.
Does obtaining a duplicate mean that the business can open immediately?
Not necessarily. A duplicate recovers an existing document; it does not establish by itself that the present holder, activity, layout, capacity and installations match the municipal records. A change of holder or modification may still be required, and outstanding deficiencies or other conditions may need to be addressed.
What can I do if I cannot find the activity-file number?
Collect the full address, details of the previous holder and any related communication, decision, project, plan or payment letter. Barcelona’s District Technical Services provide certain appointments for file follow-up and access or copy requests. Confirm the current contact channel, applicant eligibility and required evidence with the City Council before attending or submitting a request.
